Heritage Backyard Inc. ships products from its locations F.O.B. Heritage Backyard Inc. Customers may, at their option, engage their own shipping company or Heritage Backyard Inc. will make shipping arrangements. If Heritage Backyard Inc. makes shipping arrangements for a Customer, Heritage Backyard Inc. will handle shipping incidents as follows:

• Heritage Backyard Inc. is only responsible for shipping delays if Heritage Backyard Inc. has made Guaranteed Delivery Arrangements at the request of Customer and Heritage Backyard Inc. confirms such arrangements. Delays in shipping or delivery do not constitute a reason for cancellation of an order.
• If shipping damage occurs, Heritage Backyard Inc. will repair or replace products at Heritage Backyard Inc.'s option.
